These Terms and Conditions (“Terms“) govern access to and use of this website, its content, and any digital products offered through it. By accessing, browsing, or using this website, you confirm that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with these Terms, please do not use this website.

  1. Nature of the Website

SkribusVOX is an independent, author-led creative project focused on writing and digital art.

All content published on this website is provided for artistic, cultural, expressive, and contemplative purposes. Nothing on this website constitutes legal, medical, psychological, financial, or professional advice of any kind.

Use of this website and its content is entirely voluntary and at the user’s own responsibility.

  1. Use of the Website

You agree to use this website lawfully, respectfully, and in accordance with these Terms.

You may:

  • View and access content for personal, non-commercial purposes.
  • Contact the author for professional inquiries, collaborations, or licensing requests.

You may not:

  • Copy, reproduce, modify, distribute, scrape, or republish content without prior written authorization.
  • Use the website or its content for unlawful, fraudulent, or harmful purposes.
  • Interfere with the website’s operation, integrity, or security.
  • Reverse engineer, decompile, or attempt to derive the creative process or technical methodology behind any artwork.

Unauthorized use may result in access restriction and legal action where applicable.

  1. Intellectual Property and Licensing Framework

All content available on SkribusVOX — including texts, essays, digital artworks, images, visual compositions, downloadable files, branding, and design — is protected by intellectual property laws and remains the exclusive property of SkribusVOX and its author, unless expressly stated otherwise.

The purchase of a digital artwork does not automatically transfer copyright, but is governed strictly by the license type acquired.

SkribusVOX offers the following three license types:

  1. a) Private Collector License

For personal and private use only.

Permitted:

  • Private ownership and personal display.
  • Limited personal printing.
  • Storage on personal devices.

Not Permitted:

  • Commercial or corporate use.
  • Public or commercial exhibition.
  • Resale, redistribution, sublicensing, or modification for dissemination.
  • Use in artificial intelligence training, machine learning, or derivative generation.
  1. b) Corporate / Interior Use License

For commercial, corporate, or institutional interior spaces.

Permitted:

  • Professional printing.
  • Physical display in offices, hotels, studios, or commercial interiors.
  • Decorative interior use only.

Not Permitted:

  • Digital redistribution or online publication.
  • Use in advertising, marketing campaigns, merchandise, or derivative products.
  • Transfer of the digital file to third parties outside the licensed context.
  • Use in artificial intelligence training or machine learning systems.
  1. c) Full-Transfer / Digital Master License

This license grants a full transfer of digital exploitation rights for the specific artwork acquired.

Permitted:

  • Unlimited use, modification, reproduction, redistribution, and commercial exploitation.
  • Delivery of professional-grade digital files suitable for commercial production.

Conditions:

  • The transfer applies only to the specific artwork purchased, not to the SkribusVOX brand or other works.
  • The author retains irrevocable moral authorship rights, including the perpetual right to be credited as the creator in accordance with the Berne Convention for the Protection of Literary and Artistic Works (Article 6bis).
  • SkribusVOX reserves the right to display the artwork for portfolio, archival, catalog, and authorship reference purposes only.
  • This license requires a separate written agreement (Sales License Agreement) executed prior to final delivery.
  • Buyer must not misrepresent authorship or remove artist attribution from the work. 
  1. Artwork Removal and Exclusivity

Once a digital artwork is sold under any license typeSkribusVOX will:

  • Remove the artwork from its public gallery.
  • Cease offering the artwork for sale on this or any other platform.
  • Refrain from commercial resale or relicensing of the artwork.

The artwork may only remain visible in the artist’s portfolio, personal archives, and curated catalogs or documentation showing authorship and provenance.

This ensures artistic exclusivity while preserving the author’s moral right to attribution.

  1. Digital Products, Licensing, and Sales Process

6.1 Licensing and Contractual Requirements

All sales of digital artworks require a formal Licensing Agreement, regardless of license type.

  • Private Collector License: Requires completion of standard licensing terms before file delivery.
  • Corporate/Interior License: Requires completion of corporate licensing terms before file delivery.
  • Full-Transfer / Digital Master License: Requires execution of a comprehensive Sales License Agreement with additional specifications prior to final delivery.

Each license agreement will specify:

  • The exact scope of permitted uses.
  • Duration of the license (perpetual or time-limited).
  • Restrictions on use, modification, and distribution.
  • Confidentiality and non-disclosure obligations where applicable.

6.2 Documentation Package

Upon purchase, the buyer receives:

  • Certificate of Authenticity (COA): Certifying the artwork’s provenance, authenticity, and legal ownership transfer (where applicable).
  • Sales License Agreement: The binding legal contract specifying all permitted and prohibited uses.
  • Technical Specification Sheet: Detailing delivered file formats, resolutions, color space, and printing recommendations.
  • Artist Statement (where applicable): For certain artwork types, documentation of the creative process at the artist’s discretion.

All documents are provided in PDF/A archival format and may be digitally signed for legal validity.

6.3 Price Differentiation

License pricing reflects the legal scope and commercial rights associated with each license type:

  • Personal licenses grant individual, non-commercial rights with minimal legal exposure and are priced accordingly.
  • Corporate licenses include commercial use rights, multi-location permissions, and compliance with business auditing standards.
  • Full-Transfer licenses grant unlimited commercial exploitation and represent the full market value of the work.

SkribusVOX reserves the right to refuse licensing to customers who indicate intent to misuse lower-tier licenses for purposes exceeding the granted rights, including commercial use of personal licenses or corporate distribution of personal files.

6.4 Final Sales Conditions

  • All sales are final once files are delivered or access is granted.
  • The applicable license is clearly stated before purchase confirmation.
  • Certain licenses, especially the Full-Transfer / Digital Master License, may require prior communication and contractual agreement.

6.5 Nature of Digital Products

SkribusVOX sells digital art files exclusively. No physical products are manufactured, printed, or shipped.

Each purchase consists of:

– Professional-grade digital file(s) delivered electronically

– Certificate of Authenticity (digital and/or blockchain-verified)

– Sales License Agreement (digitally signed)

– Technical specification sheet

– Artist statement & creative process declaration

The buyer is responsible for:

– Printing the artwork (if desired) through their preferred print service

– Selecting materials, dimensions, and finishing options

– Framing and installation

SkribusVOX provides printing recommendations in the Technical Specification Sheet but does not offer printing services or guarantees regarding third-party print quality.

  1. Refund Policy

No refunds are issued after purchase, except in cases of:

  • Verified technical error (corrupted files, download link malfunction, delivery failure).
  • SkribusVOX failure to deliver promised files within 30 days of purchase.

Refund Process:

  • Refund requests must be submitted within 30 days of purchase with documented evidence of the technical issue.
  • Refunds will be processed within 14 business days of approval.
  • Once a license agreement is executed and files are accessed, refunds are not available regardless of buyer satisfaction.
  1. Right of Withdrawal (EU Consumers Only)

EU consumers have the right to withdraw from this purchase within 14 calendar days without providing reason, under the EU Digital Content Directive (Directive 2019/770).

This right expires immediately upon:

  • Confirmation of download or access to the digital content.
  • Execution of the Sales License Agreement (where applicable).

By downloading, accessing, or accepting the license agreement before the 14-day period expires, you confirm that you understand this right expires and accept the digital content accordingly.

  1. Confidentiality and Protection of Creative Process

9.1 Artist Workflow Confidentiality

The artist’s specific creative process, methodologies, tools, and proprietary techniques are considered Trade Secrets and Confidential Information.

Buyers acknowledge that:

  • Detailed workflow information is not included in documentation.
  • General categories may be provided for transparency purposes only.
  • Specific creative methodologies remain confidential to protect the artist’s competitive advantage and intellectual property.
  • This confidentiality does not affect artwork quality, file specifications, or the buyer’s ability to use purchased files within the licensed scope.

9.2 Prohibition on Reverse Engineering

You agree not to attempt to:

  • Reverse engineer, decompile, or analyze the artwork to derive the creative process.
  • Use purchased artwork as training data for artificial intelligence, machine learning, or derivative generation systems.
  • Publicly disclose, share, or commercialize information about the artist’s creative methodology.

Violation of this section may result in immediate license termination and legal action.

  1. Unauthorized Use and Consequences

10.1 License Violation

Unauthorized use beyond the granted license may result in:

  • Immediate license termination without refund.
  • Legal action for copyright infringement and breach of contract.
  • Monetary compensation for damages, calculated as minimum 3X the original license price or actual damages, whichever is greater.
  • Legal fees and court costs where applicable.

10.2 Misuse of Lower-Tier Licenses

Using a Personal or Corporate license for purposes exceeding the granted rights (including but not limited to commercial exploitation, AI training, or redistribution) constitutes a material breach of this agreement and is subject to the penalties listed above.

  1. Third-Party Services

This website uses the following third-party services:

  • Hosting Provider: Hostinger
  • Payment Processing: Wise Bank Transfer, or similar
  • Analytics: Google Analytics, Plausible, or similar
  • Email Service: Webmail
  • Digital Signature: DocuSign or similar for contract execution
  • Blockchain Registration: Verisart (optional, for Certificate of Authenticity)

SkribusVOX is not responsible for interruptions, failures, data breaches, or policy changes of third-party providers. Each third-party service has its own privacy policy and terms of service, accessible on their respective websites.

  1. Limitation of Liability

All content and services are provided “as is” and “as available.”

SkribusVOX shall not be liable for:

  • Direct or indirect damages arising from use or inability to use the website.
  • Personal, emotional, artistic, spiritual, or financial expectations.
  • Interpretations or decisions made based on published content.
  • Data loss, service interruptions, or failures caused by third-party providers.
  • Technical issues, including file corruption or download failures (except where SkribusVOX is directly responsible and refund mechanisms apply).
  1. External Links

This website may include links to third-party websites. SkribusVOX does not control or endorse external content and assumes no responsibility for it.

  1. Force Majeure

SkribusVOX shall not be liable for delays or failures in performance of its obligations due to causes beyond reasonable control, including but not limited to:

  • Natural disasters, acts of God, or environmental catastrophes.
  • Cyberattacks, data breaches, or security incidents affecting third-party providers.
  • Hosting provider failures, network outages, or technical infrastructure collapse.
  • Regulatory changes or government actions that prevent service provision.
  • Pandemics or public health emergencies.

In such cases, SkribusVOX will make reasonable efforts to resume service and notify affected users.

  1. Modifications to Terms

SkribusVOX reserves the right to modify these Terms at any time. Updates will be published on this page with a revised date.

Continued use of the website constitutes acceptance of the updated Terms. Material changes will be communicated via email to customers with active transactions, where applicable.

  1. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by international legal principles and the substantive laws of the jurisdiction where the website operator resides, without prejudice to mandatory consumer protection laws applicable to you in your country of residence. In the event of dispute, both parties agree to be bound by international legal standards and conventions.

16.2 Dispute Resolution Process

Any dispute arising from or relating to these Terms, the website, or any purchase shall be resolved according to the following tiered process:

Step 1: Good Faith Negotiation (Mandatory)

  • The disputing party must notify the other party in writing (email: contact@skribusvox.com) detailing the dispute and desired resolution.
  • Both parties commit to resolving the matter in good faith within 30 days of notification.
  • Informal mediation is encouraged during this period.

Step 2: EU Online Dispute Resolution (EU Consumers Only)

  • If you are an EU consumer and the dispute remains unresolved after 30 days, you may access the EU Online Dispute Resolution (ODR) Platform at: https://ec.europa.eu/consumers/odr
  • This platform allows EU consumers to submit complaints and seek mediation without initiating litigation.

Step 3: International Arbitration (Binding)

  • If the dispute is not resolved through good faith negotiation or EU ODR (where applicable), any remaining dispute shall be resolved through binding international arbitration according to the following terms:
    • Arbitration Rules: WIPO (World Intellectual Property Organization) Arbitration Rules
    • Arbitration Seat: Geneva, Switzerland
    • Arbitrator: A single arbitrator appointed in accordance with WIPO rules
    • Language: English
    • Governing Convention: New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958)
    • Costs: Each party bears its own costs; arbitrator fees are split equally unless otherwise determined by the arbitrator based on the outcome.

Benefits of This Arrangement:

  • Neutrality: Geneva is internationally recognized as a neutral forum for dispute resolution.
  • International Enforcement: Awards are enforceable in over 170 countries.
  • Confidentiality: Arbitration proceedings are private.
  • Expertise: WIPO arbitrators specialize in intellectual property and digital content disputes.
  • Efficiency: Arbitration typically resolves disputes faster than traditional litigation.

16.3 Waiver of Jury Trial and Class Action

By accepting these Terms, you waive the right to jury trial and agree that disputes shall be resolved on an individual basis. Class action lawsuits are not permitted under this clause.

16.4 Small Claims Exception

Either party may pursue claims in small claims court if the claim qualifies under applicable local law and the claimant waives the right to arbitration for that specific claim.

  1. Data Controller Information

SkribusVOX is operated by:

SkribusVOX is the data controller for all personal data collected through this website, as defined under the General Data Protection Regulation (GDPR) and other applicable privacy laws.

  1. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction or an arbitrator, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

If a provision can be reformed to be enforceable while preserving the intent of the parties, it shall be reformed to that extent.

  1. Entire Agreement

These Terms, together with the Privacy PolicyLegal Notice, and any separate written agreements (including Sales License Agreements), constitute the entire agreement between you and SkribusVOX regarding the use of this website and the purchase of digital products.

Any prior negotiations, representations, or agreements not included herein are superseded by these Terms.
